Rule for capture of fugitive resources
Fugitive resources: oil, gas, water
They belong to the owner of the land there are in. But when they “escape” the title of the former owner is gone
Can domestic animals be captured?
No - if an animal can return back home, cannot be captured
Rule for capture of wild animals on UNCLAIMED LAND
The first to capture or mortally wound is the owner; pursuit is not enough
Rule for capture of wild animals on OWNED LAND
Land owner has some rights to the animals via constructive possession
Special rules
1) If you capture a wild animal, but it escapes back to nature, then you no longer have title over it
2) If you capture and “tame” a wild animal, it becomes “domestic,” so it cannot be captured by someone else if it escapes
