What is an EIR?
Environmental Impact Report
- information document which has to be considered by every public agency prior to its approval or disapproval of a proposed project
- purpose of EIR:
1. identify significant impacts on the environment
2. identify alternative measures for projects to mitigate impacts
3. indicate manner in which impacts can be mitigated or avoided
identify CEQA exempt projects
California Environmental Quality Act (CEQA) exempt projects include:
- urban area, construction/conversion projects with a scope up to 3 single family units
- accessory structures including garages, patio, fence
- emergency repair to public services buildings necessary to maintain service or prevent damages
- projects by public agencies to repair or replace facilities damaged by natural disasters
- installation, repair or maintenance projects of less than 1 mile with a public street

define mitigated negative declaration.
A negative declaration is determined for a project when:
- initial study has identified potentially significant effect but:
1. revisions to project plans made by applicant to avoid or mitigate the effects so that it will have no significant impacts on the environment
2. no substantial evidence before public agency that the project, as revised, has any significant impact on environment.
what is a negative declaration?
- briefly describes reasons a project will not have a significant impact & does not need the preparation of an EIR
- should include:
1. brief description of project
2. project location
3. findings that the project will not have significant impact
4. copy of initial study & mitigation measures
what is an initial study?
- preliminary analysis prepared by lead agency to determine if EIR or negative declaration is required or identify significant impacts to be analyzed in EIR.
Should contain:
1. description of project
2. identification of environmental setting
3. checklist of impacts & ways to mitigate them
4. review of project for consistency with existing zoning & general plans
5. name of person who prepared initial study
