Section 4 persons authorized to enter and inspect premises of institutions reports
Marshal, head of the fire department or delegate, may enter any reasonable hour any building or other premises, or any ship or vessel to make inspection or investigation, without being held or deemed guilty of trespass, and can make inspections every three months,
Section 5 Upon premises and removal of combustible materials, conditions to be remedied penalty
The marshal, head of the fire department or delegate, upon complaint of a person having an interest in any building or premises or property adjacent thereto shall at any reasonable hour enter into buildings, and upon premises, as to the existence of conditions likely to cause fire, they should order such conditions to be remedied, they may enter into such building or upon such premises and remove such refuse or any useable materials or abate such conditions at the expense of the owner or occupant,
any such owner or occupant who fails or refuses to comply with said order shall be punished by a fine of not more then 50 dollars for each consecutive 48 hrs during which such failure or refusal to comply continues
Section 6 Neglect or refusal of officers to comply with sections 2-5
Any city town or district officer who willfully neglects or refuses to comply with any duty or requirement imposed upon him by the preceding sections hall be punished by a fine not less than 25 dollars or more then 100 dollars
Section 9 Rules and Regs relative to explosives and inflammable materials
The board shall make rules and regulations for keeping storage use manufacture sale handling transportation or other disposition of explosive and inflammable fluids and compounds, may prescribe the location materials and construction of buildings to be used for any of the said purposes shall require persons keeping storing using selling manufacturing handling or transport
Cities and towns my also make enforce ordinances and bylaws not inconsistent with said rules and regs, any ordinances or bylaws shall submit copy to the board within ten days after passage or has not been approved or disapproved by the board within ninety days after the receipt therof shall be deemed to have been approved
Section 10 Rules and regs relative to fire prevention public hearings
The board shall hold public hearings on the first Thursday in May and October in each year and at such other times as it may determine, on petitions for changes in the rules and regs formulated by it, it shall appoint a day for further hearing and shall give notice therof and of the changes proposed by advertising in such newspapers and where appropriate,
Section 10B Penalty for violation of rules and regs of the board
Any person who knowingly violates any rule or regulation made by the board of fire preventions regulations shall except as otherwise provided be punished by a fine of not less than 100 dollars nor more tan 1000 dollars
10C Alteration, repair and installation of oil burners necessity of certificate exceptions
no person shall alter repair or install any oil burning equipment or any of the appurtenance therto, except for electrical wiring and connections, installation and operation of oil burning equipment and the keeping storage and use of fuel oil or other inflammable products used in connection therewith, unless he holds a certificate of oil burner technician
the cleaning of oil burner strainer or nozzle or cleaning or replacement of photo cell may be done by owner or manager of building without certificate
Section 10D Application for certificate as oil burner technician, terms of certificate examination and electrical work
any person who has attained 18 years of age may make application to the department for certificate as an oil burner technician, may not apply more often then once in thirty days, after one month of receipt of his application the applicant shall be examined, if found to be qualified he shall be issued certificate forthwith,
certificate is good for no less then 12 months and no more then 24 months then must be renewed on date of birth of the person
if the birth day is feb 29 it shall expire on march 1
notice of the date of expiration of a license shall at least 30 days prior to such date be sent to the licensee
Section 23 Keeping and use of inflammable fluids, permit , fee
Except as otherwise provided by rules and reg the board of fire prevention, no volatile inflammable fluid except an amount not exceeding 1 quart in approved safety can and no non volatile inflammable fluid except an amount not exceeding ten gallons for domestic use shall be kept in any building used for habitation
and no more then 1 gallon or exceeding 30 gallons except in the tank of automobile motor boat or stationary engine, shall be kept within 50 feet of a building used for habitation
A fee of not more then 50 cents may be charged for any permit granted under the authority of this section
Section 24 Keeping and handling of fire menace material carpenter or paint shop in habitation
no part of any building use for habitation nor that part of any lot within 50 feet except as permitted by section 23 be used for storage, keeping or handling of any article or material that is or may become dangerous to the public safety as a fire menace, and no carpenter shop or paint shop nor for the storage keeping or handling of excelsior shavings sawdust cotton paper stock feathers or rags except under such terms and conditions as the head of the fire department may prescribe in writing
Section 26B Automatic fire warning ans smoke detection systems in certain building appeals,
every building or structure not exceeding 70 feet in height above the mean grade erected or substantially altered to the occupied for residential purposes shall be protected with an approved automatic fire warning system in accordance with the provisions of the state building code. such system shall include the features of automatic smoke detection in conjunction with the approved fire detection devices
Whoever is aggrieved by the head of the fire departments interpretation order requirement, may within 45 days after service of notice thereof appeal from such interpretation order requirement direction or failure to act to the board of appeals as provided in state building code and section 23 of chapter 23b
Section 26C Automatic smoke or heat detectors for apartment house not other regulated
Apartment houses containing six or more dwelling units hotels boarding or lodging houses or family hotels which are not regulated by section 26a or 26b shall be equipped with automatic smoke or heat detectors as provided by the rules and regs of the board of fire preventions
Head of the fire department shall enforce the provision of this section
Section 26D Definitions applicable to residential smoke detectors
Approved monitored battery power smoke detector shall be a smoke detector which is activated by a battery power source provided that the battery is monitored to assure that the follwoing condition are met
