define the Mental Health Act (MHA)
used for those >16yrs who will not be voluntarily admitted
define Section Two of the MHA
admission of a patient >16yrs for up to 28 days that is non-renewable
- for at risk cases and those with no underlying diagnosis
requirements for Section Two of MHA
application by approved mental health professional or nearest relative
recommendation from 2 doctors - one of which is approved under Section 12
define Section Three of MHA
admission of patient >16yrs for treatment of up to 6 months that is renewable
- requires a diagnosis
- requires recommendation of approved doctor and 2 doctors seen within <24hrs
define Section Four of MHA
used in emergency situations until Section Two is achievable
- requires recommendation of only 1 doctor and an AMHP or relative
- allows 72hrs of detainment before converted into Section 2
define Section Five (2) of MHA
a voluntary patient in hospital is legally detained by a doctor for 72hrs
define Section Five (4) of the MHA
a voluntary patient in hospital is legally detained by a nurse for 6hrs
define Section One-Hundred and Thirty Six of the MHA
police can bring someone who appears to have a mental health disorder from a public place to a place of safety
criteria of the MHA

define the Adults with Incapacity (Scotland) Act 2000
a framework for safeguarding the welfare and managing finances of those >16yrs that lack the capacity or are unable to communicate
how is capacity assessed?
patient must show an impairment or disturbance in the functioning of the mind or brain and be unable to undertake:
understanding of relevant information
retainment of relevant information
weighing up of the relevant information
communication of a decision
