A

What are the stages of capacity ?

A

A person can listen, retain and repeat in their own words the information given. They can weigh up and use the information as part of the process of making a decision.
The person should be able to then communicate their decision back to you

A

A

Only relate to medical treatments
Only in the negative to refuse medical treatment of a specific type

A

The presence of a mental disorder as defined by law
Disorder is of a certain nature or degree
Significant risk to the persons health, safety or safety of others
No alternative to hospital admission as means of safeguarding that risk

What is section 5 (4) ?

A

Power granted to detain an inpatient ( someone is already admitted to hospital ) for up to 6 hours for medical assessment where mental illness is suspected.( cannot be done in ED )

A

The RMO or nominated deputy can detain an inpatient for up to 72 hours ( cannot be done in ED )
It allows formal mental health act to be completed.
