what is a section 5(2)
a patient who is a voluntary patient in hospital can be legally detained by a doctor for 72 hours

a patient can be admitted up to 28 days by an approved mental health professional or nearest relative under the application of two recommended doctors which one is a psychiatrist( section 12 approved) and treatment can be given against a patients wishes

an individual with a known diagnosis needs treatment for 6 months
already got condtion 6 months
what is a section 136
someone in public place who ha mental health disorder can be taken to police or place of safety for 24 hours - police constable

nurse can detain patient who is voluantarily in hospital for 6 hours
what is the role of a AMHP
gather inf and assessing doctors
lassies with other gaencies
conduct interview and risk assessment and arrange transport

arrange for care or children or pets
what is the difference bwweten section 2 and section 3
section 2 lasts up to 28 days - used when treatment plan is unclear and it can be connected to section 3 at any point
section 3 lasts 6 months and is used when the treatment plan is fairly clear
what are alternative methods of detention
arrest and the criminal justice system
social MHA section for mental disordered offenders
DOLS - deprivation of liberty safeguards - part of MCA authorising detention for physical and nursing care
can all sections be stopped

under 5(2) can use reasonable force - does not authorise treatment only detention - still prescribe sedation - against will must be under mental capacity act- this means they lack capacity - IM sedation is left defensible as long as you’ve offered oral
