4) If board states “suspension” or “revocation”: file complaint w/ Administrative Court
Grounds for discipline (15): name them quickly
1) fraud/deceit in obtaining license
2) substance abuse affecting pt safety
3) mental/physical condition affecting pt safety
4) aiding practice as a “licensed optometrist” when not actually licensed
5) incompetence: a) lack of ability to do perform your duty as an OD, or b) lack of knowledge to apply principles/skills to do your job
6) unprofessional conduct - violates commonly understood standard
7) conviction of crime involving dishonesty/false statement - up to ONE YEAR jail time
8) false advertising
9) practicing in practice w/o proper materials
10) practicing under a name different than the one on your license
11) representing your title as something OTHER than an OD
12) 3+ offices w/o consent of the board
13) failure to display diagnostic/therapeutic license
14) splitting/dividing fee w/ anyone other than associate, OR accepting/giving a rebate to an optician
UNAUTHORIZED associations (5):
1) Associations: with another individual/practice NOT licensed to practice optometry
2) Aiding unauthorized practice
3) Loaning your license (to someone who isn’t licensed)
4) Mercantile employment (commercial practice)
5) CONTINUING unauthorized associations
T/F: Licensed ODs, under CORPORATE practice, can’t association w/ an unlicensed OD, firm, or corporation for profit that allows the OD to practice optometry
