What is a listed Building?
A building of special architectural or historic interest.
What does A listing mean?
Building is an outstanding example of a period, style or building type.
What does B listing mean?
Building is a Major example of a period, style or building type.
What does C listing mean?
Building is representative of a particular period, style or building type.
If undertaking work to a listed building what do you require?
Planning Permission through the Planning, Listed Buildings and Conservation Area Act Scotland 1997. Through application to the local authority.
What is a conservation area?
An area of special architectural or historic interest which is desirable to preserve or enhance.
What is a Building Preservation Order?
Protection order that can be placed on a building that is unlisted but one that is of special interest. Order lasts for 6 months and protects the building from demolition.
What works require listed building consent?
Any Major Works
Works that would be considered to alter the character of the building.
Stone Cleaning
Window Replacement
Roof Replacement
Demolishing part or whole of a listed building
Change of use from house to hotel
When is Conservation Area Consent required?
When demolishing a building within a conservation area.
When is a building warrant required?
Alter
Extend
Convert
Demolish a building
Why must a building warrant be obtained?
Must be obtained prior to commencement of works under The Building Scotland Act 2003.
What may happen if works carried out without a Building Warrant?
Criminal offence therefore the local authority planning department can pass the matter to the procurator fiscal. Local authority can apply an enforcement notice
What is a letter of comfort?
Letter issued from local authority when:
Unauthorised building work
Building Warrant has expired
Or
Building Warrant not required.
How are building warrant application fees calculated?
Based on the cost of the works in accordance with The Building Fees Scotland Regs 2004.
Can you alter works onsite from the building warrant approved drawings?
It would be an offence to carry out work that was not in accordance with approved plans. A formal amendment to the warrant should be sought. Best practice to discuss changes with building standards officer also.
