It is lawful to supply liquor to a person under 19 years of age when liquor is supplied?
In a residence or private place by a parent of the person supplied or person having lawful custody and the liquor is consumed at the place supplied.
3 Part Test
1) intoxicated by alcohol
2) is in a public place or common area
3) arrest is necessary for the safety of any person
According to the LLCA, a police officer finding a person apparently intoxicated, take the person into custody, and may, in lieu of laying a charge:
Escort the person to a hospital designated by regulation.
Part 2 Test
1) find a person apparently in contravention of this act
2) refuses to give his or her name and address or reasonable grounds to believe that the name or address given as false
If a police officer or conservation officer finds a person apparently in contravention of the liquor license and control act or it’s regulations, and the person refuses to give his or her name or address or the officer reasonably believes the identification is false. The officer may:
Arrest the person without warrant
