Talk me through the advice you gave regarding contract selection, procurement route and tendering strategy?
Give me an example of the concern your raised and the advice you gave?
For Whiteparish Ward at Salisbury Hospital I assessed the differences between a JCT D&B and ICD CDP Contract for the project. I took consideration of the Clients requirements including early cost certainty, Contractor involvement in design, speed, transfer of design responsibility to the contractor and adherence to tight project timescales. This meant that the two stage renderings strategy was selected as the mos appropriate tendering strategy. In addition to the D&B contract as the design wasn’t fully complete.
What advice did you give regarding the selection of the most economic tender?
For bournemouth hospital, contract 11 I advised the procurement team that Randell were the most economic tender compared with the other tendering contractors based on the tender summary comparison sheet. I advised them that even though they were the most economical tender there were concerns relating to the significant cost differences from the other tenders. I advised the procurement team that the lowest tenderer should be contacted to provide opportunity to amend their submission for any errors. Also that a thourough review of the M&E should be undertaken by the m&E consultant.
Give me an example of the advice you gave regarding tender errors for Contract 11?
Randell had errors relating to the inclusion of additional provisional sums for items which required firm costs including supply and installation of the cleaners sink, kitchen sink. They also had a mathematical error relating to the calculation of contingency sum. They did not provide a breakdown of their preliminaries cost and combined the cost of two projects into one. With alternative 2 tendering option selected the procurement team approached Randell to either accept or amend the errors.
Explain how you have calculated an appropriate level of liquidated damages in the past.
I have not had to calculate a level of liquidated damages in the past as they have been provided by the client, however if I were to calculate a level of liquidated ascertained damages LADs for a new set of flats I would review calculate with the Client the loss of lease from rooms. I would also look at the amount of construction supervision costs and fees, finance costs.
Why did you advise the lowest tenderer on contract 11 royal bournemouth hospital ?
I advised the procurement manager that all the tenderers should be contacted to amend their tenders following exclusions of works, calculation errors. I highlighted concerns as to why the lowest tender was so much lower than the four received which was 500,000 less than the others. for a total contract of 2.5m. Thorough review was undertaken between m&e consultant and contractor to ensure that the contractor was providing a fixed price.
