What is a Relevant Event?
Is a list of instances within the contract, if those instances happen and create a delay for the contractor they may be entitled to and EOT.
The contractor will still need to provide evidence and prove the ‘event’ has caused the delay for the EOT to be granted.
What can be deemed as a relevant event?
Variations
A change or alteration to the quantity or quality of the works
Instructions
timing of instructions that cause a delay
Deferment of Possession
delay in handing over the site to contractor (Common to have a 6 week timeframe of when possession will be handed over)
Suspension by the Contractor
the contractor is entitled to be paid at certain stages of the contract. If the contractor hasn’t been paid by the employer he is entitled to suspend the works.
Impediment by the employer
Employer is hindering contractor from carrying out works, not providing access to certain areas of site etc
Statutory Undertaker carrying out statutory undertaking Utilities organisations such as Gas and Electric and Water carrying out works
Exceptionally Adverse Weather out of the norm weather for the last 10 years, can be checked on the Met office or JCT website, have a link up between both where you can review weather for said location
Specified Perils Fire, Flood, Lightening etc
Civil Commotion
Lock Out / Strike
Force Majeure
