Lesson 9 - Custodial sentencing Flashcards
deterrence
the unpleasant prison experience is designed to deter an individual from engaging in offending behaviour in the future
general deterrence - sends a broad message to society that crime won’t be tolerated
individual deterrence- should prevent the individual from recommitting
incapacitation
offender is taken out of society to prevent them from reoffending as a means of protecting the public - the need for incapacitation depends upon severity of the crime
retribution
society is enacting revenge for the crime by making the offender suffer
rehabilitation
upon release, prisoners should be better adjusted and ready to take their place in society
prison should provide opportunities for employment after prison
psychological effects of custodial sentencing
psychological disorders
institutionalisation
brutalisation
labelling
psychological disorders
prisons have a higher incidences of mental illness such as depression
institutionalisation
spending time in prison leads to a lack of autonomy, conformity to the role of prisoner and a dependancy on prison culture
brutalisation
prison acts as a school for crime and reinforces criminal lifestyle and criminal norms- leads to high recidivism .70% of young reoffenders re offend within 2 years
labelling
prisoners lose touch with previous social contacts as its hard to gain employment after prison, therefore increased likelihood of reoffending
+ evaluation of custodial sentencing
+ it can be useful bcs it shows justice has been done and limits the danger to the public. Many prisoners access education and training whilst in prison , increasing chances of employment
- evaluation of custodial sentencing
- suicide rates are 15% higher in prison populations
-8-10% of all criminals commit 50% of crime , custodial sentencing is best reserved for repeat offenders - crime prevention is more effective than custodial sentencing bcs it avoids labelling a person as a criminal and the negative consequences of prison
