What are examples of HBA?
- Murder
- Unexplained Death (suicide)
- Controlling Sexual Activity
- Physical Abuse
- Fear of, or Actual Forced Marriage
- Domestic Abuse
- Sexual Abuse, Rape
- Forced Abortion
- Abduction
- Stalking and Harassment
What should you do when confronted with HBA or FM?
- Take them seriously
- See them immediately alone
- Respect their wishes and reassure them
- Establish a means of safe contact
What should you NOT do when confronted with HBA or FM?
- Send them away/minimise their concerns
- Approach family or community (interpreters)
- Share information without consent
- Attempt to mediate
What does Section 8 of the Victims and Witnesses (Scotland) Act 2014 allow a victim of HBA or FM do?
Choose the gender of the interviewing officer
How may a victim of HBA or FM present themselves?
- Anxious/angry (fight or flight response) or
- Numb/non-engaging /dissociated (freeze response)
- Unable to understand and respond to things said to them or be unable to react or recall information in a coherent way
What legislation prevents FGM?
Prohibition of Female Genital Mutilation (Scotland) Act 2005
What is the penalty for FGM?
Up to 14 years imprisonment
What defences are there for FGM?
- Where the the female has given birth and an approved person removes it for purposes connected with Labour or birth.
- Where an approved person carries out a surgical operation which is necessary for that persons mental or physical health
What does Article 16 of the Universal Declaration of Human Rights state?
Marriage shall be entered into only with the free and full consent of the intending spouse
What does Section 122 of the Anti-Social Behaviour, Crime and Policing Act 2014 criminalise?
- Forcing someone to marry against their will
- Luring a person to a place for the purpose of forcing them to enter into a marriage without consent
- Using deception with the intention of causing a person to leave the UK with the intention of forcing them to marry
Scotland’s Sheriffs may issue a civil Forced Marriage Protection Order (FMPO) on an application made by who?
- The protected person;
- A relevant third party i.e. Local Authority; Police Scotland, the Lord Advocate and any other person specified by Scottish Ministers
- Any other person only with the leave of the court (Section 3 (2) of the Act makes specific mention of this)
What are the possible risk factors for HBA/FM?
- Truanting
- Self harm
- House arrest
- Dishonourable behaviour
- Family/community
- Fear or actual forced marriage
- Pressure to go abroad
- Isolation
- Domestic abuse
- Attempts to separate or divorce
- A pre-marital relationship/extra marital affairs
- Threats to kill
- Animal/pet abuse
- Children
- Pregnancy/new birth
- Sexuality
- Stalking and harassment
