Define alcohol
“…..does not include alcohol which is of a strength of 0.5% or less, at the time of the sale”.
What is a licensing board?
Alcohol must only be sold on premises that have been granted a licence by the local licencing board.
They have no less than 5 and no more than 10 members.
What are the 5 licencing objectives?
Listed within the Licensing (Scotland) Act 2005, underlying basis for any decision made by licensing boards.
- Preventing crime and disorder
- Securing public safety
- Preventing public nuisance
- Protecting and improving public health
- Protecting children and young persons from harm
Role of Licensing standards officer
Providing interested persons with information and guidance concerning the operation of the act in the area
Supervising compliance of premises and occasional licence holders
Providing medication services to avoid or resolve disputes or disagreements between licence holders and any other persons
NB they have power to enter and inspect licensed premises and any substances, articles or documents found there that the LSO thinks necessary. To ensure that actives being carried out are in accordance with the premises licence or occasional licence.
Any person working must provide them with assistance, info and documents.
Any person who obstructs them commits an offence.
