Define firearms

A

Firearms Act 1968

  • A lethal barrelled weapon of any description
  • From which any shot, bullet or other missile can be discharged and includes:

1) Any “prohibited weapon”, whether lethal barrelled or not
2) Any “component part” of such lethal or prohibited weapon
3) Any “accessory” to such weapons which are designed or adapted to diminish the sound or flash caused by the weapon.

NB they must have barrels and be capable of discharging some kind of missile. They can be made out of table legs, piping etc.

Define Air Weapon

A

S1 Air Weapons and Licensing (Scotland) Act 2015

“An air weapon, that is to say, an air rifle, air gun or air pistol which does not fall within s5(1) of the Firearms Act 1968, and

1) the component parts of an air weapon
2) any accessories to such a weapon designed or adapted to diminish the noise caused by discharging the weapon

NB must discharge a missile with kinetic energy of more than 1 joule to fall under definition.

What is a component part of a firearm?

A

Any part which is essential for firing the weapon.

Not including things like the butt of a weapon.
They are included for obvious reasons. Various parts could be carried individually and later assembled into a working lethal weapon.

What are prohibited weapons under s5(1) Firearms Act 1968?

A

1) all firearms designed or adapted for continuous fire
2) most rifles which are capable of rapid fire
3) Most shotguns captable of rapid fire whose overall size make them easy to conceal on the person
4) any firearm, which is disguised as another object
5) any rocket launcher or other projecting apparatus for use with explosive rockets for millitary use
6) any air weapons that use self contained gas cartridge system, which are vulnerable to conversion.
7) firearms with a barrel length of less than 30cm or an overall length of less than 60cm
8) any other weapons designed or adapted to discharge noxious liquids, gasses or other things
