Lesson 1 and 2 - The social contract Flashcards
Social Contract
When individuals consent to abide by society’s rules and norms in exchange for the protection of their rights and interests.
Assumptions
Assumptions refer to the foundational beliefs that make up a social contract.
This is determined by three main points: the inherent nature of man, the state of nature, and a flaw.
Consideration
This word represents value exchanged between parties, such as money and other goods. It ensures a fair and mutual duty, making contracts legally valid.
Both sides have to consider the payment and reward of the document and CONSIDER the situation.
Inherent Nature
The inherent nature of humans refers to the distinct characteristics of humans in a population.
State of Nature
A hypothetical state in which government or politics does not exist or does not have any influence.
Flaw in State of Nature
No governing system is perfect, and society has a chance to fall apart.
What freedoms people give up
People might give up some of their absolute freedom to do anything they want whenever they want.
What people receive / keep
In return for giving up some freedoms, people receive protection and order in society.
When is the contract void?
when the flaw is not fixed or the remaining freedom is not protected.
Example from history when a contract has become void
The French Revolution, when the monarchy failed to address the needs of the people, led to protests and revolutions, and eventually to its overthrow.
