CQC established to regulate and provide registration and inspection of health and social care settings

What are the key features of the Safeguarding Vulnerable Groups Act?
Implemented the vetting and barring scheme to ensure unsuitable people aren’t allowed to work with vulnerable people
Employers cannot employ someone on barred list and can refer people

What are the key features of the Disclosure and Barring Scheme?
DBS checks - requirement for anyone 16+ working/volunteering with vulnerable people
Standard = all criminal convictions/cautions/ warnings
Enhanced = added info from police

What are the key features of the Mental Capacity Act?

What are the key features of the MCA - Deprivation Liberty Safeguards?
Deprivation of liberty = taking power away
If someone lacks capacity need to have independent checks before others try to make decision for them
Decisions made in best interests
DoLS ensure people who cannot consent to dare arrangements are protected if arrangements deprive liberty
What are the key features of the Equality Act?
The act protects people from discrimination, harassment and victimisation due to protected characteristics
Direct and indirect discrimination = illegal
Reasonable adjustments made
Equal access to education, foods and services
Breastfeeding in public = legal
Protection from discrimination due to association
What are the key features of the the Public Interest Disclosure Act?
Protects individuals who make certain disclosures in public interests
Provides legal framework for whistleblowing
Prevents individuals suffering detriment
Report to correct person
Employees can make complaint if they suffer detriment to employment tribunal
Defines complaints that count as whistleblowing
Protects their identity
Can whistleblow free from concern/fear
What are the key features of the Rehabilitation of Offenders Act?
Supports rehabilitation into employment of reformed offenders
Convictions become spent after rehabilitation period
Don’t have to mention criminal conviction when applying for jobs/accessing services
The rehabilitation period = overall sentence not time in prison
Employer cannot refuse to employ them due to spent caution/conviction

Every child matters
Children’s commissioner to represent views and interests
Duty of local authorities to make arrangements to promote cooperation between agencies and other relevant bodies
Local safeguarding boards set up
