What is a section 2?

A

What is a section 3?

A

Allows patients to be detained for up to 6 moths if they have a mental disorder that requires hospital treatment and it is necessary for their own health and safety or the protection of others. This section can also be renewed and extended for 6 months, 6 months and then 12 months after that. There’s no limit on the number of times it can be renewed.

A

Voluntary patients or inpatients (including being treated for a physical problem) can be kept under section for up to 72 hours.

What is a section 5(4)?

A

Voluntary inpatient receiving treatment for a mental disorder be detained for up to 6 hours by staff members, to keep the patient in hospital for their health and safety or the protection of others until a doctor or clinician can assess the patient.

A

Can be detained for up to 24 hours by a police officer if they think you have a mental disorder and need immediate care, they can take you to a place of safety until you can be assessed.

What is a section 135?

A

A police offer (accompanied with a doctor and approved mental health professional) can get a warrant to enter any premises and take the patient to a place of safety if they have a mental disorder and are either unable to care for the self or being ill-treated or neglected. They can be kept in hospital/safe place for up to 24 hours.

What is a section 117?

A

Health authorities have a legal duty to provide free aftercare for anyone who has been discharged under Mental health act sections 3, 37, 45A, 47, 48 or a community treatment order. Services should prevent a further deterioration in mental health that would mean returning to hospital.

What is a community treatment order?

A

Someone who has been detained in hospital may be discharged on a CTO, this is an order to give someone supervised treatment in the community allowing them to remain at home, but they will have to return to hospital for treatment at any point if deemed necessary.
