the intention of fighting is to correct the wrong
What is considered to be a default by international law?
peace

the right to wage war (transition form peace to war)
when war is possible?
self-defense, UN Security Council mandated action
what is self-defense regulated by?
Caroline rule, article 42
jus in bello
rules on when force can be legally used (regulates conduct during the war)
What does international humanitarian law protect?
people, objects, in general limits the effect of armed conflict
four principles of IHL
humanity, distinction, proportionality, and military necessity
principle of humanity (Martens clause)
if there is no law, then we look at morality, common usage or public opinion
principle of distinction
distinction between combatants and non-combatants
