Annual Leave
Employees are entitled to a minimum of 21 consecutive days of annual leave per 12-month cycle.
Calculation: 1 day for every 17 days worked or 1 hour for every 17 hours worked, by agreement.
Leave must be granted within 6 months after the leave cycle ends
Payment: Full remuneration is due on the last working day before leave starts or on the usual payday by agreement.
Sick Leave
Calculated over a 36-month cycle, employees receive paid leave for illness.
Medical certificate required after 2 consecutive sick days or if absence pattern indicates need.
During a three-year (36 months) period, an employee is entitled to a total number of sick leave days equivalent to the number of days they would normally work in a six-week period.
During the first six months of employment the employee is limited to one day’s paid sick leave for every 26 days worked.
Normal daily pay is provided, with potential reduction by agreement (not less than 75% pay).
Maternity Leave
4 months of unpaid leave, extendable by medical need.
Employee must notify employer in writing 4 weeks before leave starts.
An employee may not work for six weeks after the birth of her child, unless a medical practitioner or a midwife certifies that she is fit to do so.
An employee who has a miscarriage during the third trimester or bears a stillborn child is entitled to maternity leave for six weeks after the miscarriage or stillbirth.
Employer must provide suitable alternative work for night shift employees during pregnancy and 6 months post-birth.
Refusal to allow return to work post-maternity leave constitutes dismissal.
Parental Leave
10 consecutive days upon birth or adoption of a child.
Employee must notify employer in writing 1 month before expected birth or adoption.
Unpaid, but employee may claim benefits under the Unemployment Insurance Act.
Adoption Leave
10 consecutive weeks for adoptive parents of children under 2 years old.
Employee must notify employer in writing 1 month before adoption
Adoption leave commences on the date an adoption order is granted or the date a child is placed in the care of the prospective adoptive parent, whichever date is the earlier.
Adoption leave is unpaid, but the employee may claim adoption benefits under the Unemployment Insurance Act
Commissioning Parental Leave
10 consecutive weeks for commissioning parents in a surrogate agreement.
Employee must notify employer in writing 1 month before expected birth.
Unpaid, with eligibility for commissioning parental benefits under the Unemployment Insurance Act.
Commissioning parental leave commences on the date the child is born.
Family Responsibility Leave
An employee who works for at least four days a week for an employer is entitled to family responsibility leave. This entitlement accrues to the employee once the first four months of employment have been completed.
Family responsibility leave is three days during an annual leave
An employee is entitled to family responsibility leave when: – his child is born7 or is ill;
– his spouse, life partner, parent, adoptive parent, grandparent, child, adopted child, grandchild or sibling dies.
Family responsibility leave is paid leave
The employer may require proof of the event for which leave is/was required.
