What is the law commission?

A

set up in 1965 by LAW COMMISSIONS ACT 1965 it is a full-time body and consist of a high court judge and four other commissioners. It keeps all law under review.

What is the work of the law commission?

A
  • Makes proposals for law reforms. Concentrates on ‘pure law’. After consultation they’ll publish a report and a draft bill.
    The proposals will only become law if enacted by parliament.
  • Codifying the law. Creating coaxes to cover all aspects of law on one topic.
  • Consolidating statute law. combining several statutes into one statute.
  • Identifies old acts which aren’t in use. parliament can repeal these.

Advantages and disadvantages of law commission?

A

+Reviewed by experts
+Consults before finalising law reform
+Can simplify and modernise ‘pure law’

  • Parliament can make reforms without the consultation of law commission
  • Government is slow so some reports haven’t been made law yet
  • Some reforms may never be implemented
