Name the conditions that give rise to law reform.

A

Changing social values. The evolution or change of the ethical standards held by a society as a whole can occur as citizens attempt to move away from the influence of religion and become more ‘self-aware and self-determinative.’ For example, same-sex marriage.

New concepts of justice. When the law is unable to provide just outcomes for the people, elements of it can be abolished. For example, the abolishment of capital punishment.

New technology. Advances in tech put pressure on the law to remain relevant. Unfortunately, technology has been evolving faster than the law can be adapted and reformed.

Name and outline some non-legal agencies responsible for legal reform.

A
  • The media: the freedom of the press allows the publication of any inconsistencies or corruptions found in the law or government. Its accessibility makes it a voice of reform available to most members of a society very quickly.
  • Non-Government Organisations: typically charities, NGOs are viewed as morally sound, thus people want to follow them.
  • Lobby groups: lobby groups are made up of individuals who sway political parties or councils to align with a certain political agenda.
