What are rights?

A

Rights are legal and moral entitlements or permissions for all members of a community. For a right to have legal basis, it must be protected by law and enforceable.

What are the types of legal rights?

A
  • Express rights are clearly and absolutely outlined in the constitution. The Racial Discrimination Act 1975 (Cth) protect one’s freedom from racial prejudice.
  • Implied rights are civil and political rights that can be inferred from the Australian Constitution, rather than being expressly stated. For example, the right to vote is implied in S7 and S24 of the constitution.

What are moral rights?

A

Moral rights may be argued from different viewpoints. They may or may not be upheld by those who possess such a viewpoint. An example of this is the right to fidelity which is not legally binding, and therefore not enforceable.

What is a Bill of Rights? What is Australia’s called?

A

A Bill or Rights is a source of freedoms and responsibilities in a society. Such a document sets out specifically what individuals are entitled to expect of their government.

Australia is the only Western democracy that does not have one.
