A
  • it was 6 colonies making their own laws
  • to alllow for federation the colonies had to give up some of their powert o the commonwealth parliament

what are residual powers?

A

law-making powers that were left with the states. The Commonwealth Parliament generally has no authority to make laws in these areas
e.g. of residual power: PT, education, criminal law, road law

what are concurrent powers?

A

law-making powers that are shared by the Commonwealth and the state parliaments.
e.g. trade, taxation, marriage, divorce, postal/telecommunication services

what are exclusive powers?

A

law-making powers that are held only by the Commonwealth Parliament, and
only that parliament can create laws in these areas (the states cannot create law in those areas)
e.g. defence, currency, customs/border protection
