Concepts of law, key points.
-Peaceful and problem, free society is achieved by rules and laws for people to abide by.
-Create a society where justice, fairness and equality is provided by the courts and government apply with their jurisdiction
-protection for victims, and those who have broken law should be punished.
Fault based liability
Play more responsibility where something has gone wrong.
Integral to English law system .
-And evidence of crimes were MENS REA ,state of mind accused, to be proven.
-Based on blame worthy activity, blame —> punishment/remedy.
Strict liability
Both criminal and civil law ,no intention required, has acted alone and is therefore sufficient evidence to be guilty/liable. E.g negligence
-A breach of duty —>liable
-The defendant involuntarily committed an offence, may still be guilty.
