Rule/Statute - Enforcement 153.001
GENERAL POWERS AND DUTIES OF BOARD; Sec. 153.001. ADOPTION OF RULES. The board may adopt rules and bylaws as necessary to:
(1) govern its own proceedings;
(2) perform its duties;
(3) regulate the practice of medicine in this state; and
(4) enforce this subtitle.
Laserfiche (LF)
is the document management system utilized by the TMB
10 day assignment
Within 10 days of a new case assignment, the assigned field inv. will set up the LF folders for that case using only the standard folder names.
Case File Folder
Title given to the folder that reflects the investigative file number (e.g., 16-2844)
Folders
reflect contents within the main Case File Folder (e.g., Tab 05 (A-B) Respondent responses, etc.)
Subfolders
created within folders as needed, largely for evidentiary documents for multiple service dates or for medical staff or risk management records that can be sub-categorized. (e.g., Tab 05(A-B) Respondent responses, etc…)
Documents
any pages that are scanned or imported into LF (e.g., Complainant letter, medical records, etc…)
Labels
Numbers assigned to medical records evidence (e.g., discharge summary)
Affidavits
This is the only document that goes into this folder; it is not necessary to use the word “affidavit” in the name of the document.
Board Orders
All board orders, including date of the order.
Complaint
this folder would include the initial complaint and subsequent information from the complainant (FO-1)
Correspondence
Includes all of the Austin letters, Field Investigator letters to “R”, “C”, witnesses, etc. This folderd may also contain cover letters from attorneys, pharmacies, other witnesses, emails to attorneys, and witnesses, etc. If letters are sent via certified mail, the accompanying “green card” will be scanned into this folder. Please remove all blank documents, such as waivers and sworn statements. Documents should be named accurately to reflect what they are. All Investigation field notes are to be in this folder.
DPS Reports
The reports should be named to reflect what they contain.
