Juvenile
- any person under 18
- behavior is governed by impulse rather
than rational thinking - brain is still maturing and developing
well into the mid 20s
Delinquent Child
- 12-18 years old
- under 12 lacks the mental capacity to
form criminal intent
Delinquency
applies to acts that if performed by an
adult, would be termed criminal
Care and Protection Order
ANYONE can initiate
- To remove children from abusive and
unsafe environments
LOCATIONS TO TAKE A JUVENILE
- Med. facility
- Residence
- Police Station
Youthful Offender
14-18-
- Applies to juveniles who committed a
felony and
> previous DYS Commitment
> committed certain firearm offenses
> committed an offense that involved the
infliction or threat of serious bodily harm
Mandated Reporters
a person in his/her profession, has
reasonable cause to believe a child is
suffering physical or emotional injury
resulting from abuse or neglect (or
financial exploitation)
- duty to report to DCF immediately and
file a written 51A within 48hrs
- Ex: Police officers, nurse, teacher,
doctor, emt, firefighter
First step of a 51A
Orally notify DCF
- Written report - within 48 hours
Protective Custody
- when you take a juvenile (intoxicated)
without their permission
-have right to phone call - keep separate from adults in custody
(sight and sound) - check every 15 minutes)
How long can you hold a youthful
offender?
- 6 hours
CHILD REQUIRING ASSISTANCE
(CRA)
- 6-18
- Law requires children to be notified of
their right to counsel upon the filing of an
application and have counsel present at
all subsequent hearing
> Runaway/Stubborn Child
> Habitual School Offender / Habitually
Truant
> Sexually Exploited - police must submit
CRA application
DYS
- Can approve cells (where we can keep
juveniles)
CHILD REQUIRING ASSISTANCE
(CRA)
- 6-18
TRANSFERRING JUVENILES
- Cannot be placed in Patrol Wagon
- Inform operations departure point,
mileage and time = arrival point, time
and mileage - shall NOT handcuff while taken into
custodial protection for a child requiring
assistance under 119 S 39E
DCF
extended services for ages 18-24
