Judicial Notice: i.e. that a judge may take judicial notice of an indisputable fact
What is 201(a) about?
The only facts a judge can take notice of are Adjudicative Facts [those relevant to the case at bar]
What type of facts may be judicially noticed under 201(b)?
Those not subject to reasonable dispute because
* (1) is generally known
* (2) can be accurately and readily determined
How does a court take judicial notice (201)
201 (b):
* (1) may take judicial notice on its own; or
* (2) must take judicial notice if a party requests it and the court is supplied with the necessary information.
Summarize 201
Judges may take judicial notice of adjudicative facts that are not disputed, they may do so at any time.
So long as it is timely, a party may request an opportunity to be heard on the fact they want noticed
