Counterclaim

Permissive counterclaim
counterclaim that DOES NOT derive from the SAME TRANSACTION OR OCCURRENCE, as P’s claim and therefore MAY be filed as a counterclaim.

Compulsory counterclaim
derives from SAME TRANSACTION OR OCCURRENCE as P’s claim and therefore MUST be filed it will be bared.
