Investigate whether FV is being, has been or is likely to be committed which
- Is a criminal offence or;
- Has put a person’s safety at risk
Section 5A ROA - Definition of FV
Violence, or a threat of violence, by a person towards a family member of the person; or any other behaviour by the person that coerces or controls the family member or causes the member to be fearful.
Examples of FV - Offences under s.128 CIA
An assault against a family member
Sexual assault or other sexually abusive behaviour against a family member
Kidnapping or deprivation of liberty
Damaging or destroying property of the family member
Examples of FV - Not Offences under s.128 CIA
Stalking or cyber stalking family member
Repeated derogatory remarks against the family member
Causing death or injury to a animal belonging to family member
Unreasonable control of finances
Unreasonably withholding financial support to meet reasonable living expenses
Preventing family member from making or maintaining connections with family, friends or culture
Distributing or threatening to distribute personal images of family member
Causing any family member who is a child to be exposed to FV
A person who procures a another person to commit FV is …

Victim expressing fear or fear/intimidation is apparent is FV
