Everyone over 16 is presumed to be competent unless the opposite is demonstrated
If a child <16 years has sufficient understand no intelligence to enable him or her to understand what is proposed, then he or she will be competent to give consent
If a child is not able to give consent someone with parental responsibility may do so on their behalf
