What is EMTALA?
ALL patients that present to ED (anywhere on campus) must be treated - do medical screening exam, address any emergency medical condition
Applies to all hospitals/providers who participate in Medicare
May transfer under EMTALA rules if:
- Patient stabilized
- Unstable patient will benefit from higher level care
- Patient requests transfer
Medical Screening Exam in ED must consist of what?
Chief complaint Vital signs General appearance Mental status Ability to walk Focused PE
What are reportable events that HIPAA does not protect?
Various circumstances of Death Child/Elder Abuse/Neglect Sexual Assault Knife and Gunshot wounds Communicable Diseases (STIs, food poisoning, etc) Animal Bites Epilepsy - DMV Threat of Harm to self or others
What is implied consent?
Assumption is made that the average, reasonable, competent patient would agree to standard treatment in an emergency situation if they were able to
When does DNR apply?
stop CPR or ACLS if patient’s heart stops beating or they stop breathing
can continue IV oxygen, meds, fluids
Good Samaritan Laws
Protects health-care professionals who render aid at the scene of an emergency.
Requires that the person act reasonably, in good faith, without compensation, and without gross negligence or harmful intent
