A

Situation - too many people left team as too challenging w exams. Deadlines

Task I was left with was to help navigate us all through the deadlines and complete things in time

Action - to complete this task, I delegated tasks to everyone. Who is legal researcher, who works on respondent memoranda. In return, I was going to help them with commercial law essay. This helped a lot.

Outline the pre-action protocol for clinical negligence claims

A

Civil procedure rules sets out the following steps parties must following before starting a claim in court.

-it aims to encourage early settlement
-reduce costs
-avoid unnecessary litigation

  1. Initial investigation and letter of notification
    -solicitor requests medical records from nhs or private clinician

-defendant must provide records within 40 days under data protection act

-medical expert consulted to assess breach of duty and causation

-if negligence is suspected, claimant sends letter of notification to defendant

  1. Letter of claim
    Formal letter of claim sent to D setting out:

-summary of facts of case
Allegations of breach of duty
Injuries suffered and their many
Prelim valuation of damages
D encouraged to notify indemnity insurer (nhs resolution for nhs claims)

  1. Letter of response
    Dependent has 4 months to investigate and reply w letter of response stating:

-admitted liability for settlement negotiation to begin

-or deny liability, for claimant to decide whether to proceed w court

  1. ADR and settlement discussions
    -both parties encouraged to settle out of court via
    -negotiation
    -mediation
    -ombudsman complaints
  2. If no settlement, issue court proceedings
    -claim must be issued within 3yr limitation period

What is the test for medical negligence

A

Four elements must be met

1) duty of care must be owed to patient (professional rship must exist)

  1. Breach of duty by failing to meet accepted standard of care. Didnt act in a way a competent professional would
  2. Causation - breach of duty has to directly caused harm

Factual causation - ‘but for’ doctors actions, injury wouldn’t have moored
Legal causation - harm caused must be fire able or linked to breach

  1. Damages
    Actual harm or damages as to have been suffered as result of negligence e.g physical injury, distress or financial loss
