What are the types of interim costs orders?
Costs in any event, Costs in the case, Costs reserved, Claimant or D’s costs in the case, Costs thrown away, Costs of and caused by, Costs here and below, No order for costs
What are costs in any event?
Party in favour of order awarded costs from other party regardless of who eventually wins at trial
What are costs in the case?
The party who wins will recover costs from the interim hearing
What are costs reserved?
The decision about who pays costs of interim hearing put to later occasion
What are C or D’s costs in the case?
In C’s costs in case, if C is successful and received order, will be entitled to costs at end of trial. If D wins, C does not have to pay D’s costs.
The same works in reverse.
What are costs thrown away?
If judgement set aside, party in favour is entitled to costs incurred as a result of judgement being set aside.
What are costs of and caused by?
Costs resulted from one party caused by another amending statements of case (or something else)
What are costs here and below?
Can claim costs from lower court unless appeal from Divisional Court
How are costs in any event assessed?
Summarily assessment
When must a party pay costs in any event?
Within 14 days of court order being made
