What is the offence in regards to insurance certificates?
A
A person must not…
- drive a motor vehicle on a road or public place unless there is in force a policy of insurance
- cause or permit another person to drive a motor vehicle on a road or public place unless there is in force a police of insurance
- an insurer must deliver a certificate of insurance to the recipe t and should the vehicle be driven before this the offence will be complete
- an “Agency” can receive the certificate on your behalf before coming to you so this is sufficient to bypass the offence
- if someone lends their vehicle with a strict condition to insure it first they are NOT permitting

What are the defences to driving without insurance?
A
That a person…
- was using the vehicle in the course of their employment
- that he did not know and had no reason to believe it was not insured
- the vehicle did not belong to him or was under a hire or loan contract
- a drivers employer must support the notion that the suspect was acting in the course of their employment. The suspects own account is not enough
- garage employees returning a vehicle are not in the employ of the owner
- an employee driving a vehicle in an unauthorised manor will not invalidate the insurance
- an insurance police obtained by deception will still be valid until it is voided

What is the difference between social and domestic purposes?
A
Social includes…
- lending a vehicle to a friend in exchange for reimbursement of fuel costs
- using a vehicle to help a friend move home
… it does not include…
- business trips
- using the vehicle outside of an employer’s terms will not necessarily invalidate a policy; an employee who went 2hrs out of the way to give someone a lift did not
