Equal Protection
State is treating people differently
singling people out doesnt mean discrimination.
Some people a group or class, they are being treated differently than everyone else

Procedural and Substantive
Substantive Due Proccess
Taking away or regulating a right for all people.
fundamental right = we apply strict scrutiny.
Non fundamental right= rational basis
Liberty rights.
Fundamental rights
RTF and CAMPER

Property Rights:
Notice and a hearing.
Governmental jobs, professional licenses, and public benefits
Make sure property right is vested- not on probation
14th amendment and 5th amendment
State= 14th equal protection or due process
Federal/ Congress = 5th treat people differently
Privileges and Immunities
Residents vs non residents
*If a state pass a law which discriminates against person because they not a resident (treat non residents diff).
13th vs 15th amendment
13- bans slavery
- private people can be prosecuted for racial discrimination
15th- voting and race
-trying to stop or make it difficult for people to vote based on their race.
Takings clause
- The government shall not take private property for public use unless they pay just compensation (FMV).
Takings Clause- Public Use
Taking private property for public use
even if priv indiv owns the proj or land as long as effect public overall jobs economy taxes overall greater good then its for pub use even if priv indiv owns it.
Inverse Condemnation
ur prop is condemned. They doing sum that denies u the economic benefit of ur land- now so basically a taking.
What doin is now gonna destroy economic benefit of my land, its worthless.
Lemon Test and New Test
oLemon test: to determ if what gov does violates establishment clause
1. The law has to have a secular purpose (non religious)
2. It may not advance or inhibit religion.
3. There shall be no excessive entanglement with religion: usually money
New Test:
Stay neutral as to religion not prefer one over the other.
Establishment Clause
Gov cnt pass any law which seems to establish a religion.
- Cnt b preference for 1 religion over another
Free Exercise Clause
Every citizen has the right to practice his or her religion any way they choose.
The gov must remain neutral as to how we practice our religion.
- cant do anything to stop you from exercising you relgion
-If rule on face neutral but effect prevent me practicing religion, then its not a violation
-A law neutral to religion will be constitutional even if the effect prohibits religion.
Speech- Content Based
When the gov is trying to stop the message from getting out. Basing regulation on the content.
