What is an inclusive environment?
One that is designed and managed to allow people with a diversity of needs and abilities to use and access it. Should be a focus throughout the property lifecycle.
What factors should we be aware of?
Different physical and mental health issues, factors that can lead to social isolation, the value that this can bring to owners and occupiers.
What was highlighted within the Equality Act 2010?
Consolidated discrimination law and protection against discrimination.
Four illegal types of discrimination:
Direct
Indirect
Harassment
Victimisation
When faced with an obstacle to access for disabled persons, what does the Act say we must do?
Remove or alter the feature, provide reasonable means of avoiding the obstacle or access to the service
Provide examples when testing for ‘reasonableness’
1) Effectiveness of the adjustment for the disabled person.
2) The practicality of the adjustment.
3) It’s financial cost and likely disruption.
4) Financial and other resources available to the service provider.
What do you know about The Equality Act 2010?
- It extends the obligations to all ‘controllers of let premises’
- It is unlawful for those managing buildings to discriminate against or victimise an occupier.
- Lettings, sales, assignments and other forms of disposal must not be undertaken in a way which could discriminate, harass or victimise a person.
- Landlords need to ensure that all dealings with a tenant / occupier who could have a protected characteristic are dealt with in accordance with the Act’s provisions.
