attempt
a person has made an effort to commit an offence but does not successfully complete it
elements of attempt
- the offence in question must be one that can be attempted
- D commits an act
- more than merely preparatory
- intended to commit the full offence
indictable only offence
offence that can only be tried in crown court. can be attempted eg. murder, robbery
either way offence
an offence that can be tried in crown or magistrates. can be attempted eg. theft, burglary, low value shoplifting
summary only offence
offence only tried in magistrates. cannot be attempted eg. common assault

more than merely preparatory
actually tried to commit the offence in question. putting yourself in a position or equipping yourself is not an attempt
mens rea of attempts murder
substantive offence can be committed with an intention to kill or an intention to cause GBH
Attempted offence can only be committed with an intention to kill
mens rea of attempts Arson
substantive offence can be committed with intention or recklessness to cause damage or destruction by fire
attempted offence can only be committed with an intention to cause damage or destruction by fire
attempting the impossible
can still be liable for an attempt even in circumstance where the commission of the offence would be factually impossible.
eg stabbing someone that is already dead - you can’t kill twice but you tried
impossibility by inadequate means
you poison someone but it is not real poison - you can still be liable for attempted murder
3 routes for impossibility
Factual - d can still be liable even if the offence is factually impossible
Inadequate means - factually and legally impossible but have inadequate means to carry it out
Legal - cannot be liable where the offence is legally impossible
