Q

Transactional Immunity

A

If a person is offered this type of immunity, they cannot be prosecuted for any crime they talk about. This means that, if a person is offered this type of immunity, they should say as much as they possibly can about all the crimes they committed, because this evidence cannot be used against them in the future.

Q

Use Immunity

A

If a person is offered this type of immunity, the information they provide cannot be used to prosecute them. They can still be prosecuted for crimes they admit to, the prosecution will just have to prove that they did not directly or indirectly use any of the information the person provided under this immunity to pursue their prosecution. Prosecutors can typically still prosecute people who have use immunity by splitting up into two teams. One who questions the witness, and another who is not present for questioning and therefore does not have to worry about directly or indirectly using what they say while investigating their crime.
