What is required for registration of Lawyers?*
1) File Registration Statement!!!
- With Office of Court Administration
- Every 2 years!!!
- Certifying Lawyer is in full compliance with continuing legal education requirements + pro bono reporting + contributions + outstanding child support obligations!!!
2) Pay registration fee ($375) w/ each filing
3) Complete form registration
What are newly admitted Lawyers required to do?
Accredited transitional education (min. 32 hours)
- Within 2 years of admission
- 16 hours per year
- Ethics + Professionalism (3 hours)
- Skills (6 hours)
- Practice management + Professional practice (7 hours)
What may be considered as misconduct and discipline?*
Violation of Rules of Professional Conduct
Conduct involving;
- Dishonesty
- Fraud
- Deceit
- Misrepresentation
- Prejudice to administration of justice
Unlawful discrimination in employment based on;
- Age
- Race
- Creed
- Colour
- National origin
- Sex
- Disability
- Marital status
What may happen if Lawyer violates Rules of Professional Conduct?*
1) Reported to Attorney Disciplinary Committee of appropriate Appellate Division Department
2) Possibly either;
- Censure
- Suspension
- Disbarment
What is Lawyer NOT allowed to do in Non-authorised jurisdictions?
NOT practise law in violation of other jurisdiction’s regulations
NOT aid non-lawyer
When may Lawyer be subject to the Rules of Professional Conduct if they provide non-legal services?
Recipient could reasonably believe non-legal services are subject of lawyer-client relationship
How may Lawyers offer non-legal services?
Contractual relationships w/ non-legal professionals/firms (included in Joint Appellate Division Rules)
- Architecture
- Accountancy
- Engineering
- Land surveying
- Social work
NOT through non-lawyers as part of Lawyer’s/Law firm’s services
What is required for Lawyer to provide pro bono services?
1) At least 50 hours of qualifying pro bono legal services per year
2) Financial contributions to organisations providing legal services to poor persons in equivalent amounts billed by Lawyers per year
