What constitute an offense
Behavior that is a crime or violation under this code (HRS) or another statute of this state.

What is the definition of crime
Any offense defined by any code or statute in this state for which a sentence of imprisonment is authorized
What are the 3 grades of a crime
1) Felonies
2) misdemeanors
3) petty misdemeanors
What is the imprisonment terms for a Felony Offense
Imprisonment which exceeds more than one year
What is the imprisonment terms for a Misdemeanor Offense
Terms of imprisonment for a maximum of 1 year
What is the imprisonment terms for a petty misdemeanor offense
Imprisonment for a term not to exceed 30 days
If an offense does not specify a certain grade what would be the authorized grade of conviction

What are Murder/attempted murder in the first and second degree classified as
Felony offenses
What is a violation
An offense where imprisonment is NOT authorized and is only a fine, or fine and forfeiture or other civil penalty
A violation doesn’t constitute a crime
What offenses has not time limitation and can be commended at any time
- Murder/attempted murder in the 1st and second degree
- criminal conspiracy to commit murder in any degree
- sexual assault in the 1st and 2nd degree
- continuous sexual assault of a minor under 14 years old
What is the statute of limitation for manslaughter (not involving a motor vehicle)
10 years
What is the statute of limitation for a class A felony
6 years
What is the statute of limitation for any felony under part IX chapter 708 (computer crimes)
5 years
What is the statute of limitation for class B and C felonies
3 years
What is the statute of limitation for a misdemeanor or parking violation
2 years
What is the statute of limitation for a petty misdemeanor or violation other than a parking violation

What is the exception for time limitations in regards to Fraud, Deception, or Breach of Fiduciary obligation
within 3 years after discovery of the offense but no more than 6 years
What is the exception for time limitations in regards to Misconduct of a public office
Any offense based on misconduct in office by a public officer or employee at any time when the defendant is in public office or employment or within 2 years thereafter but no more than 3 years
What is the exception for time limitations in regards to DNA testing
If DNA testing of a suspect was performed prior to the expiration of the time limitation for the offense, the time limitations shall not exceed more than 10 years from the period of expiration
When is and offense committed and when does the limitation start
A offense is committed when every element occurs and the time limitation starts the day AFTER the offense is committed
