An accused person claimed the right to be tried in the more lenient church courts.
In theory who was the benefit of clergy for?
Priests, they can read the bible
What is the neck verse?
Its the verse from the bible u get to read if u ask for ‘benefit of clergy’. It was only intended for priests since they are the only people that can read but criminals learnt it of by heart, saving them from the noose
What is sanctuary?
If somone is on the run from LAW they can take sanctuary in a church.
What happens when a criminal takes sanctuary?
They are under protection by the church, even sheriff couldnt touch them. Only lasts 4️⃣0️⃣ days.
What happens after 40 days in sanctuary?
Offender either faces trail or leaves country
What happens if u choose to leave after 40 days?
Make their way, barefoot, carrying a wooden cross, to the nearset port and take the first ship leaving the country.
When did trial by ordeal end?
1215
What is trail by ordeal?
All the trials (except cold water)
What was trial by ordeal used for?
Used to judge guilty or innocence when jury couldnt make up their minds.
Bad tho cause inno peeps could be found guilty and vicea versa.
