  • previously the electoral college members were appointed by the state governments and now they are directly voted for
  • however it is still possible to win the popular vote but loose the election due to loosing the electoral college
  • as seen for Clinton vs Trump she won 65,850,000 but lost the electoral college

  • shows good COMPRIMISE between federal and state governments
  • demanding amendment process has PREVENTED BAD PROPOSALS allowing the constitution to continue as the FF would have envisioned, without short term emotional needs creating life long changes
  • ADAPTABLE to widely agreed upon changes in American society
  • VAGUENESS allows for interpretive amendments by the SC
  • SEPARATION OF POWERS is enshrined and places limits on the power of the government allowing for bipartisanship

what does it mean that a weakness of the constitution is that the federal government has eroded state powers

A
  • since cooperative federalism began in the 1930’s, with FDR’s response to the great depression, but does allow for federal government to be supported during times of national crisis –> Covid 19-$2 trillion, Cares Act 2020

  • makes it difficult to add or remove parts as seen with the ERA
  • shows tyranny of the minority –> Scalia 2%
  • more than 11000 proposed by only 27 ratified
  • conservatives would argue that judicial review gives the SC enough power to interpret the SC, without amending it
