LTA 1998, S.73?
Power to obtain blood - specimen/sample take in hospital by a DR, med.prac who is in immediate charge of the examination/care or treatment of the person, another med.prac or med.officer
What happened to the blood specimen taken in this manner?
1)Inform the DR you believe the driver was involved in a accident and request a sample of blood be taken 2)DR/Authorised person opens the sealed blood specimen collecting kit and takes the blood sample…

3)The DR will take blood from the person and collect it in 2 containers 4)The DR completes Parts B and C of the blood specimen med.cert and seals the containers with a security seal, The DR also completes Part E where appropriate…

5)Bar codes from the blood specimen collecting kit are attached to each of the 2 containers and Part F (all four pages) of the blood specimen med.cert 6)The E.O takes possession of the samples and completes the Part D of the blood specimen med.cert…

7)An E.O couriers the blood to ESR within 7days 8)The courier receipt is attached to Part G of the blood specimen med.cert

What is the med.prac in immediate charge of the exam, care or treatment of the driver obliged to know or do under statue before taking a blood specimen under this section.
MUST; a)have RGTS that the person is in the surgery/hospital as a result of an accident involving a MV b)be satisfied that the taking of a blood specimen would not be prejudicial to the persons proper care and treatment c)tell the person (unless the person is unconscious) the blood specimen is being taken under this section for evidential purposes
Who maybe required to undergo CIT are?
Same as Drug Impaired Driver Procedure

-Driver/person attempting to drive a MV on a road -Person who an EO has GCTS has recently committed an offence against this act that involves driving a MV -Driver of a involved in a MV accident -Person who EO has GCTS was in a MV involved in an accident where the officer is unable to ascertain who the driver was at the time of the accident

(2)An EO may require a person specified under (1) to;
(a)Remain in the place where stopped for a period of time that is reasonable in the circumstances to undergo the compulsory impairment test or

(b)Accompany an EO t another place to undergo the compulsory impairment test if it would enhance road safety, personally safety, the persons privacy or the giving or taking of the test

A person who has undergone a compulsory impairment test until after the result of the test is ascertained

An EO may arrest a person without warrant if the person refuses or fails to comply with subsection (2) or (3)

An EO may exercise the powers in subsections (1) and (2) in addition to any breath screening tests under S.68 or evidential breath tests under S.69 and regardless of the comment of any such tests
Offences a driver can be arrested for?
If the driver is uncooperative and refuses to remain or accompany arrest for refusing to remain/accompany. Once back at the station CIT should continue
