Causes of driver impairment?
- Alcohol
- Drugs
- Medical factors such as Diabetes
- Other factors such as mental state, fatigue
Sources of evidence available to an enforcement officer to ESTABLISH GCTS a driver is impaired?
(a)Driving OBS (b)Drivers BEHAVIOUR (c)WITNESS evidence/complaints (d)Other OBS (corroborating evidence) (e)SAFETY (f)QUESTION to test attention
(a) Driving observations
- When MOBILE…weaving across the road, straddling the centre line, headlights off
- When STOPPING…striking the kerb, stopping abruptly
(b) Driver behaviour
Slurred speech, blood shot eyes, unbalanced, flushed skin
(c) Witness evidence
Note and record statements and complaints given by witnesses about the manner of driving
(d) Other observations
CLUES inside the vehicle for DRUG PARAPHERNALIA, SMELL of DRUG USE
(e) Safety
GCTS driver has CONSUMED DRUGS there maybe an associated HEALTH RISK and maybe SEVERELY AFFECTED requiring MEDICAL help. Driver, public and staff safety is PARAMOUNT.
(f) Questions to test attention
consider questioning to assess their ability to concentrate, understand and respond appropriately. An impaired driver may not be able to process 2 requests at the same time
S.71A An Enforcement Officer may require to undergo a CIT once GCTS has been established

An offence for a person to DRIVE/ATTEMPT to drive a MV on a road while IMPAIRED due to controlled drugs/prescription medication
CIT procedure
Not a random test. GCTS MUST EXIST PRIOR to any requirement to undergo testing
Any Enforcement officer who has GCTS a driver is impaired by drugs MAY?
REQUIRE the driver to ACCOMPANY to a place or REMAIN at a place to undergo CIT
A person detained for CIT maybe searched under?
S and S Act 2012, S.85
Once GCTS has been formed that the driver has consumed drugs or alcohol what MUST you say?
I now require you to remain/accompany me to ……..Police station or other such place for the purpose of a Compulsory Impairment Test, blood test or both
