Definition of murder

A

1) Where a person kills another unlawfully the killing shall not be murder unless the accused person intended to kill, or cause serious injury to, some person, whether the person actually killed or not.
(2) The accused person shall be presumed to have intended the natural and probable consequences of his conduct; but this presumption may be rebutted.

A

Life in prison.

From 2010 to 2013, murder convicts served an average term of 19.5 years–up several years from previous survey period.

The Law Reform Commission has changed from recommending this be abolished in 2008 to saying it should be kept in 2013.

A
  • Where a woman “by any wilful act or omission causes the death of her child, being a child under the age of twelve months” and- But for section 3, the crime would be murder, and
  • “At the time of the act or omission the balance of her mind was disturbed by reason of her not having fully recovered from the effect of giving birth to the child or by reason of a mental disorder (within the meaning of the Criminal Law (Insanity) Act 2006)”
