Exception to the prohibition of compulsory testing
- When a person is charged with any crimes punishable under the Revised Penal Code
- When the determination of the HIV status is necessary to resolve the relevant issue under Family Code of the Philippines (e.g. Annulment of marriage on the ground of concealment of STI at the time of marriage or on the ground of one of the parties is afflicted with and STI found to be serious and apparently incurable).
- When complying with the provision of RA 7170 (Organ Donation Act) and RA 7719 (National Blood Services Act)
