WHAT ARE THE CDM REGULATIONS 2015?

A

Construction Design and Management Regulations ensure H&S issues are considered during a projects development so the risk of harm to those that build, maintain and use the structure is reduced.

WHAT DO THE CDM REGULATIONS 2015 APPLY TO?

A

Apply to all building and construction work.

Domestic clients would usually pass the responsibility to duty holders, i.e. Contractor.

Whereas commercial clients must make arrangements for management of the Health & Safety in a proportionate way. This is outlined within the CDM Regs with duties for each party, including Principal Designer, Principal Contractor and Client.

WHAT ARE THE KEY IMPLICATIONS OF THE CONSTRUCTION, DESIGN & MANAGEMENT REGULATIONS 2015?

A

More focus on clients to put in place arrangements to ensure health and safety.

Clients can no longer assign their legal responsibilities to their agents.

There must be a declaration for how long Contractors will be given to plan and prepare for construction works.

Clients are deemed to assume the role of Principal Contractor for any period where other appointments aren’t made.

A
  • Plan, manage, monitor and co-ordinate H&S (Pre-Construction)
  • Identify, eliminate or control foreseeable risks
  • Ensure the Client and designers are aware of their duties and advise the Client on bringing together Pre-Construction information
  • Provide relevant information to other duty holders
  • Liaise with Principal Contractor in planning, monitoring and co-ordination of the construction phase

WHAT IS AN F10?

A

F10 notifies the HSE of the project, it should contain:

  • Address of the construction site
  • Brief description of the project and construction works entailed
  • Name of Local Authority where it is situated
  • Contact details for the Client and Principal Contractor
  • Indicate length of time provided by the client for the PC to plan and prepare for construction work
  • Provide a planned date of commencement and completion
  • Number of people at work at any one time on site

A
  • Plan, manage, monitor and co-ordinate construction phase in line with Building Regulations
  • Take responsibility for their site, including ensuring the proper insurances are in place
  • Work with designers and other Contractors to ensure compliance with Building Regulations
  • Monitor and record building works, liaising with the Principal Designer to agree any changes

A

DOMESTIC:
- Not generally required to carry out their duties as they are passed to other duty holders, i.e. Contractor.

COMMERCIAL:
Must make arrangements to ensure H&S risks are managed, including:

  • Appoint competent duty holders
  • Allow sufficient time and resources
  • Prepare and provide relevant information for duty holders
  • Ensure the Principal Designer and Contractor carry out their duties
  • Provide welfare facilities

A

Information useful for the planning of future works or maintenance, such as:

  • Brief description of the works
  • Any residual hazards which remain and how they have been profiled or removed, i.e. asbestos, contaminated land, water bearing strata, buried services, lead paint, pesticides. Care to be taken when handling all.
  • Key structural principles i.e. bracing
  • Nature and location of significant services, including underground cables, gas supply and fire-fighting equipment.
