PPE at work regulations 2022 - what does this regulation include?
- Extends the employers duty to ensure provision of appropriate PPE for employees and contractors to include even those in casual employment
What does a simple risk assessment outline?
- Identify the hazards present
- Identify the people at risk from the hazards
- Evaluate the risk of the hazard and consider the likelihood and severity of any accidents
- Record the findings in a suitable format
- Advises all those affected of the outcome of the risk assessment and precautions to eliminate risk
What is a method statement?
A document that details the way a work task or process is to be completed and prior approved.
It should outline the hazards involved and include a step by step guide on how to do the job safely as well as any control measures introduced to ensure the safety of those involved by the task.
A health and safety policy document is required by employers with more than 5 employees.
What 4 points MUST it contain?
1 - A policy setting out the organisations commitment to H&S
2 - Details of the organisations H&S structure and the roles/responsibilities for organising H&S
3 - A risk assessment setting the risks within the workplace and the preventative measures in place
4 - Details of the planning, implementation of the H&S policy and control measures
Can you name the ‘six pack’ of H&S regulations/compliance

What does the corporate manslaughter and corporate homicide act of 2007 include
The act relates to gross breaches of a duty of care by a coporate body that leads to a persons death.
The penalties range from an unlimited fine, imprisonment and disqualification
What does the Reporting of injuries, diseases and dangerous occurrences regulations 2013 include (RIDDOR)
- The trigger date for reporting injuries is over 7 days incapacitation
- Such an injury must be reported to HSE within 15 days from the date of the accident
- All employers must also keep a record of all 3-day plus injuries
- This info must can be kept in an accident book for a minimum of 3 years after the occupational accident/injury
Explain the Fire Risk Management Regulatory Reform (Fire safety) Order 2005
The reform is based on an RA with an emphasis on fire prevention and applies to all non-domestic properties in England/wales
The ‘responsible person is the employer or occupier who controls the property’
Must be fire precautions in place following RA
Need for good record keeping - risk assessment, fire policy and procedures and staff training.
Regular review of fire RA’s required
Matter covered in part B of the Building regulations

What does the Fire Safety Act 2021 and the Fire safety (England) Regulations 2022 apply to?
All residential premises in England and Wales including the common parts of blocks of flats and houses in multiple occupation
This was following the Hackitt review
It reforms the regulatory reform order of 2005
What does the Fire Safety Act 2021 and the Fire safety (England) Regulations 2022 require?
- A responsible person to assess, manage and reduce the fire risks posed by the structure, external walls and common areas of a building
- Regular inspections of lifts to be reported to fire service
- That residents are provided with suitable fire safety instructions
- That evacuation plans are regularly updated and that personal evacuation plans are in place for residents whose ability to evacuate may be compromised
- That individual flat entrance doors comply with current standards where the external walls have unsafe cladding
What is a FRAEW?
A Fire Risk Appraisal of External Walls
These need to be carried out on all multi-occupied blocks so the responsible persons can understand their obligations
What must a FRAEW contain?
The FRAEW report must include an assessment of the external wall system and an executive summary that the that a mortgage valuer can use to establish whether remediation works are needed or not to ensure the fire safety of the building
What does the Fire Safety Act 2021 and the Fire safety (England) Regulations 2022 allow the fire service to do?
Take enforcement action against responsible persons who fail to comply
What is an EWS
External Wall System
What is an EWS1 form?
An ESW1 form allows for the valuation of tall residential buildings such as:
- Blocks of flats
- Student accommodation
- Assisted living and care homes
- Houses in Multiple Occupation (HMO’s)
- Mixed use blocks where there is a residential component
Why were EWS1 forms introduced?
Following the Grenfell fire as many external wall systems of tall residential buildings were found to be unsafe
An ESW1 form enables a qualified professional to confirm that an external wall system of a tall resi building has been assessed for safety in line with government guidelines
What does the criteria of an EWS1 form set out?
- The height of the building
- The type of cladding and how much of it there is on the building
- The presence of balconies and combustible materials
How would you decide whether an EWS1 is needed?

How long is an EWS1 form valid for?
5 years
Can you name some of the elements of the Building Safety Act 2022?
- Accountability and duties of those responsible for the safety of high-rise buildings during construction/occupation
- Residents ability to contribute to maintaining safety
- Enforcement to deter non-compliance
- A national framework to ensure the suitability of construction materials
- The requirement for new build developers to belong to a New Homes Ombudsman Scheme
The Building Safety Act 2022 has provisions coming into force over the next 2 years - can you name some of the key provisions?
- A mandatory occurrence report is now required for each higher risk building
- New high rise resi buildings must now be registered before they are occupied
- A golden thread of information is now required for each higher risk building
- The HSE is responsible for verifying buildings works to the standards set out in the building regulations before providing a completion certificate
- The Building Safety Regulator is the Building Control Body
- The Building Safety Regulator will oversee the safety and standards of all buildings, encourage/help professionals to improve their competence and lead the implementation of a new regulatory framework for high-rise buildings
