What is the Health and Safety at Work Act 1974?

A
  • Primary UK legislation governing H & S.
  • Sets out duties of employers, self employed persons, persons in control of premises, employees, manufacturers and suppliers.
  • They must safe guard H & S of employees and public who may be affected by their work.
  • Enforced by the HSE.
  • Penalties can include fines and imprisonment.

What is the significance of the Grenfell and Hackitt Review?

A
  • UK Government produced External Wall Systems 1 Form to enable valuation of tall residential buildings (flats, student accommodation, HMOs – not hotels).
  • Form requires ‘qualified professional’ to confirm external wall system has been assessed for safety:
     The height of the building
     Type of cladding and how much
     Presence of balconies and combustible material
  • The forms are valid for 5 years.
  • Not every building requires one.
  • RICS released guidance to assist on whether form required.
  • Valuer’s must follow instructions from client and have a rationale to request form completion.
  • Large delay in form as few ‘qualified professionals’ to undertake assessment.

What is the Building Safety Bill 2021?

A
  • Building Safety Act received Royal Assent on 28/04/22. Amends Architects Act 1997 and requires c.12-48 months before majority comes into force. Currently developing secondary legislation.
  • Designed to enhance building safety. Expected implementation of Hackitt Review (Grenfell). Oversee whole built environment with local enforcement and national regulation to:
  • Ensure accountability for those responsible for safety in high-rise buildings
  • Provide resident’s ability to contribute towards safety
  • Enforcement for non-compliance
  • National framework to ensure suitability of building products
  • New build developers must belong to New Homes Ombudsman
  • Imposes new separate duties on CDM duty-holders
  • Changes to Defective Premises Act and s.38 Buildings Act limitation periods (namely Limitation Act 1980 extended to 15 years for claims to be brought)
  • Can now introduce claims up to 30 years after completion of the dwelling.

  • An Insulating material. If disturbed, can produce very small toxic fibres which can lodge in lungs and cause diseases.
  • Health and Safety Executive estimates affects 4 million properties in UK.

What does The Control of Asbestos Regulations 2012 apply to?

A
  • Applies to non-domestic and communal areas of domestic.
  • Non-compliance is a criminal offence.
  • Regulation 4 - statutory duty to manage existing asbestos in commercial property. Two obligations:
    1. Duty holder Regulation 4 – owner if vacant, tenant if holding repairing lease. Must manage risk – risk assessment, written plan and reviews recorded.
    2. Employer Regulation 5

What are the five steps for managing asbestos?

A
  1. Duty holder must assess whether premises contain asbestos – where and condition (lagging, roofing, vinyl floor tiles, ceiling tiles, roof felt, concrete spray)
  2. Assess risk and produce asbestos management plan – encapsulating / removal needed?
  3. Produce asbestos register
  4. Make asbestos register available to parties who might disturb
  5. Review register (HSE recommends every 6 months)

  • A document that contains the results of an asbestos survey: the location, amount and condition of asbestos containing materials within a building.

A
  • Management survey – locate and assess, advise on management during normal use of property. No samples taken.
  • Refurbishment / demolition survey – needed when part / all of premises upgraded / redeveloped etc. Samples taken and analysed. Recommendations made regarding management.
